You may not sub-license, sell, loan, share, lend, broadcast, rent, lease, assign, distribute, or transfer any Sample to a third party except as incorporated into a Recording
Compositions License:
Effective upon purchase/download. By using the compositions in Mono Punch Love Vol.1 (“Product”), you (“Licensee”) agree to this Agreement with Daniel Blonde / Db Samples (“Licensor”). Drum one-shots/loops are excluded and governed separately (royalty-free).
1) Definitions
Compositions: melodic, harmonic, or instrumental musical material (not drums).
New Work: your original music incorporating a Composition.
Major release: (a) release via a major label (Universal, Sony, Warner) or major distributor (e.g., Empire, The Orchard, AWAL), or (b) any release exceeding 10,000,000 total streams/sales.
2) Grant
Non-exclusive, non-transferable license to use Compositions in New Works you create, release, and monetize worldwide.
3) Independent Use
For non-major releases under the 10M threshold, no additional clearance or fees required.
4) Major Release Clearance (Required)
If a New Work using a Composition is a major release or exceeds 10M streams/sales, contact Licensor for clearance. Typical terms:
Credit: Co-producer credit to Licensor.
Royalties (producer): negotiated based on usage.
Publishing split (guide, based on amount used):
Up to 10s: 10% publishing + 0.5% producer royalty
10–30s: 15% publishing + 0.75% producer royalty
Over 30s: 25% publishing + 1.5% producer royalty
These terms apply only to Compositions (not drums).
5) Restrictions
No resale, sharing, or redistribution of Compositions (modified or not). Rights are for incorporation into New Works only. Licensor retains all copyrights in the Compositions and recordings.
6) Sync
Use of any Composition in film/TV/ads/visual media requires a sync + master use license from Licensor.
7) Termination
This license terminates if you (a) exceed the 10M threshold without clearance or (b) violate these terms. Continued use then requires a new license.
8) Indemnification
You are responsible for your use of the Compositions and will hold Licensor harmless from claims arising from unauthorized or improper use.
